General conditions of sale and use of ski lift passes for the winter season 2009/2010 (05/12/09 au 25/04/10)

1 LIFT PASSES

The lift pass is composed of a chip card on which is recorded a transport title. It gives access, during the duration of validity of the transport title, to the ski lifts in service and corresponding to the category of the said title. The user must carry his/her lift pass during the whole journey effectuated on the ski lifts. To facilitate the transmission of the encoded information during the passage through the turnstiles, the lift pass must be carried on the left and, preferably, distant from any mobile phone, keys and any form of packaging made with or in part from aluminium.

The prices of lift passes, of the transport titles and the chip cards are displayed in the ticket offices. They can also be consulted on our website: www.sevabel.com

1.1 THE DIFFERENT CHIP CARDS

1.1.1 The single use chip cards

The single use chip cards are free and can only be used once. They are delivered at the ticket offices for any ski pass except seasonal passes and online bookings.

1.1.2 The rechargeable chip cards

The rechargeable chip cards can be used once or several times during their period of guarantee of three years.

The guarantee only applies under conditions of normal usage of the chip card. It consists of supplying a new chip card to replace the defective one.

Aswell as being rechargeable at the ticket offices, the reusable chip cards make it possible to purchase a title of transportation of 3 to 14 consecutive days (-13 years, adult or +65/-75 years only) by mail order or by going to the following Internet address: www.sevabel.com.

The holder of a reusable chip card benefits from no reduction on the price of the title of transportation whether it is reloaded at the ticket offices or by phone or on the Internet.

As long as the transport title encoded on the chip card has not expired, no further transport title can be recorded on the reusable chip card with the exception of a ski area extension delivered at the ticket offices.

1.2 THE OPTION CARD

The option card is a lift pass consisting of a re-loadable chip card and a title of transportation for a duration of several days.

These days can be used either consecutively or not throughout the current season.

The titles of transportation supplied as Option Cards must be used up during the current season. Beyond this limit, they can no longer be used, furthermore there can be no refund, nor a prolongation or extension of validity.

2 CONDITION OF ISSUING AND INSPECTION OF TITLES OF TRANSPORTATION

2.1 PHOTO AND PROOF OF IDENTITY

The sale of seasonal ski passes, the sale of an Option Card as well as the issuing of free titles of transportation for a duration equal or superior to 3 days are subject to the supplying of a recent identity photo, frontal, without sunglasses or hat.

To benefit from a price reduction in function of an age category, the client is subject to produce a proof of identity.

2.2 PAYMENT METHODS

Payment can be effectuated

  • in cash in euros ;
  • by cheque drawn on a French bank account and made payable to the Sevabel ;
  • by credit card (Visa or Eurocard Master Card only) ;
  • by holiday cheques issued by the ANCV. As a security measure, payments by cash can only be accepted for purchases made at the ticket offices and not for lift passes bought on the internet or by telephone.

Furthermore, purchases made by Internet can only be settled by credit card (Visa or Eurocard Master Card only).

2.3 DELIVERY NOTE AND PROOF OF PURCHASE

2.3.1 Receipt

Will be supplied on request, whatever the chip card used, a receipt on which will be shown, for each transaction, the number of products bought, a list of said products, the total price of the transaction before tax and the total amount of the TVA (VAT).

2.3.2 Proof of purchase

Each issue of a lift pass produces a proof of purchase on which figures the nature of the title of transportation, the date of validity and its proper number.

This proof of purchase must be kept carefully so as to be presented should there be any subsequent demand or complaint.

2.4 INSPECTIONS

The lift pass must be presented at each inspection as requested by the lift pass company.

The absence of a transport title or the usage of a non conform transport title is subject to a fixed fine, to which may be added administrative charges, the amount of which is fixed by the regulations currently in force.

The falsification of a title of transportation or the use of a falsified title is subject to legal action being brought and payment of damages and costs.

In all of the cases cited above, as well as non respect of police regulations, the said passes can be withdrawn as elements of evidence for proof and/or to be given back to their owner.

2.5 TRANSMISSION AND RESALE FORBIDDEN

During the validity of the transport title, the lift pass is neither transmissible, nor transferable. It cannot be lent to a third person, the loan being free or subject to cost.

3 REIMBURSEMENT OF LIFT PASSES

Lift passes prices for several days, season or Option Cards take into account an advantageous discount

3.1 LIFT PASSES NOT OR PARTIALLY USED

In the case of a supplied title of transportation not being used, neither totally expired, the said title(s) will be neither refunded, nor exchanged.

3.2 LOSS, DESTRUCTION OR THEFT

In case of loss, destruction or theft, and on presentation of delivery note, receipt or proof of purchase, a title of transportation will be supplied for the period left to run on the pass, less one day’s excess and the chip card corresponding to the residual number of days.

This action will only be possible on presentation of receipt or proof of purchase accompanied by the payment of a sum of 10 € (for administrative costs) all the 2009-2010 winter season long.

Lift passes that are found will be kept at the central lift pass office.

Lost or stolen ski passes will be cancelled.

3.3 CLOSURE OR INTERRUPTION OF SERVICE

Should there be an interruption of service, the holder of a title of transportation may be offered a reimbursement of the prejudice suffered in the case of a complete stoppage of over half a day of all of the lifts concerned by the said transport title.

The exact workings of this reimbursement are described in the general conditions of sale and use of ski lift passes displayed, in their entirety, in the ticket offices.

The holder will be able to benefit from, after supplying the justifying paperwork (delivery note or proof of purchase and request in reimbursement duly filled in):

  • Either an immediate extension in days;
  • Or a credit note in days to be used no later than the end of the second season after that during which the credit note was accorded;
  • Or a deferred reimbursement equal to the difference between the price paid by the holder on the one part, and the number of days used multiplied by the daily rate in force.

The justifying paperwork and documents must be produced within the two months following the interruption of service. The reimbursement will take place within the four months following the receipt of the documents.

3.4 ILLNESS OR ACCIDENT AND OTHER PERSONAL EVENT

There will not be any reimbursement of transport title for any accident, illness or other personal reason whatever may be the duration of the validity of the lift pass.

An insurance service exists to cover this risk and more detailed information can be obtained from our salespeople.

4 SALES BY INTERNET OR TELEPHONE

Whatever the duration of the validity of the title of transportation, any transaction by internet will cost a fee of three euros per lift pass to get the P@S, the rechargeable chip card, at the first order. There will be no extra fee for future online reloading. At this first order, the ski passes will be delivered by post at the given address.

By simple request, the dated titles of transportation (first and last day of validity) can be reimbursed or exchanged up to 7 clear days before the 1st day of validity, with the exception of ski passes with promotional price bought on skijournee.com, which are neither exchangeable, nor refundable.

The cards P@S are never refunded.

5 INFRACTIONS TO THE TRANSPORT CLAUSES

In the case of non respect of the police regulations or the present general conditions of sale and use, the lift passes can be withdrawn to serve as elements of proof and/or to be given back to their owner.

According to the gravity of the infraction committed, the said infraction will give rise to payment of a fixed fine, to which may be added administrative costs or to legal action being brought, aswell as payment of damages and costs.

6 AUTOMATIC TREATMENT OF NOMINATIVE INFORMATIONS

6.1 AUTOMATIC TREATMENT

There is an automatic system of nominative data capture, the object of which is to constitute a database concerning lift passes and analysis of sales. The SEVABEL is responsible for this processing system.

6.2 RIGHT OF ACCESS AND RECTIFICATION

So as to conform with the law concerning computers and freedom to information of the 6th January 1978, any person concerned by this processing system has a right of opposition, access, modification, rectification and deletion of any information concerning him or her.
